These two writ petitions have been filed by the same petitioner with regard to the assessment orders in respect of adjacent premises bearing Shop Nos. 30-A and 30-B, Khan Market, New Delhi. The impugned orders are dated 05.03.2024 [with regard to Shop No. 30-A] and 14.06.2022 [with regard to Shop No. 30-B]. 2.

At the very outset, Mr. Tushar Sannu, learned Standing Counsel for New Delhi Municipal Council ["NDMC"], states, upon instructions, that NDMC is willing to reconsider the assessments after considering the W.P.(C) 17531/2024 & W.P.(C) 17565/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. objections of the petitioner and the legal contentions taken in these writ petitions.

With the consent of learned counsel for the parties, the impugned assessment orders dated 05.03.2024 and 14.06.2022 are therefore set aside, and the matter is remanded to NDMC for fresh consideration, in accordance with law.

The petitioners may file a comprehensive representation with supporting documents within two weeks from today. The Deputy Director (Tax), NDMC, will give the petitioner or his representative a personal hearing on 13.01.2025 at 3:00 PM. Fresh assessment orders may be passed in accordance with law, and the rights and remedies of the parties remain reserved.

The writ petitions stand disposed of with these directions.
