The petitioner has filed the present petition, inter alia, impugning an order dated 08.11.2023 (hereafter the impugned order) passed by the learned Debt Recovery Tribunal, Jaipur (hereafter the DRT) in SA No. 472/2022 captioned Dheeraj Kanwar & Another v. Religare Finvest Limited. 2.

The petitioner states that he had already approached the Debt Recovery Appellate Tribunal, Delhi (hereafter the DRAT) by filing the Regular Appeal No. 420/2023. However, the same has not been disposed of. In the aforesaid context, the petitioner submits that the directions be issued to the learned DRAT to decide the said appeal within the period of thirty days.

We do not consider it apposite to pass any directions, as prayed for by the petitioner. As noted above, the petitioner has taken recourse to its statutory remedies in respect of the impugned order passed by the learned DRT.

In so far as the issuance of direction for time bound disposal of the petitioner's appeal pending before the learned DRAT is concerned. 5.

We do not consider it apposite to issue any such direction for time bound disposal of a particular appeal without reference to the resources available and the total pendency before the learned DRAT. However, the petitioner is granted the liberty to file an appropriate application before the learned DRAT for early disposal.

Needless to state that if and when any such application is moved by the petitioner, the learned DRAT shall consider the same favourably, if the same is feasible.

The petition is disposed of in the aforesaid terms. Pending application also stands disposed of.
