% 21.03.2016 Crl.M.A. No.4904/2016 (Exemption) Exemptions allowed, subject to all just exceptions. Accordingly, the application is allowed.

CRL.M.C. 1139/2016 1.

Vide the present petition filed under Section 482 of the Cr P C, petitioner seeks direction thereby directing learned Metropolitan Magistrate to pass appropriate orders and dispose of the pending application under Section 173(8) of the Cr P C filed by him in case FIR No.246/2011 registered at police station Ghazipur, Delhi. 2.

Vide order dated 20.11.2015, the aforesaid application was heard and kept for orders. Thereafter, on one pretext or the other, the order could not be passed.

Keeping in view of the averments made in the instant CRL.M.C. 1139/2016

application and submissions of learned counsel for petitioner, I hereby direct learned Metropolitan Magistrate to pass the order on above noted application preferably on next date of hearing i.e. 30.03.2016 or within 20 days from the said date. 4.

In view of above direction, instant petition is allowed. 5.

Copy of this order be sent to learned Metropolitan Magistrate for compliance.
