The present petition under Section 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a) hold the respondents/contemnors guilty of contempt of this Hon'ble Court and may further be pleased to punish the respondents/contemnors as provided under Section 12 of the Contempt of Courts Act, for willful disobedience/noncompliance of the order dated 13.03.2024 passed by this Hon'ble Court in CS(OS) No. 822 of 2022 titled as "Vishal Panchal vs. Rajbala & Ors.; or b) pass such order/ orders as this Hon'ble court may deem fit and proper in the facts and circumstances of the case," 3.

Vide order dated 01.12.2025, this Court passed the following order: - "3. Learned counsel appearing on behalf of the petitioner submits The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

that respondent no. 1 had agreed to keep the petitioner with him till she is alive, in view of the settlement arrived at between the parties as duly recorded in order dated 13.03.2024 in CS (OS) No. 822 of 2022. It is pointed out that the petitioner has been thrown out of the house by respondent no.1 and she is presently residing in a shelter home.

6. Respondent no.3, i.e., Deputy Commissioner of Police, District Outer North, through the concerned SHO, shall file a status report with respect to the allegations made in the present petition." 4.

In pursuance of the directions issued, respondent no. 3/ Deputy Commissioner of Police, District Outer North, the SHO, P,S. Samaypur Badli, has placed on record a status report dated 17.12.2025, wherein it has been recorded as under: - "8. That on 14.12.2025, Vishal came to Police station where his statement was recorded in which he stated that on 18.11.2025 there was a birthday function of her daughter in which his brother was also present. His brother & his mother slapped his wife, due to this he is not willing to keep his mother alongwith him in his house, further, he stated that neither the machines nor the payment was given to him by his brother which was supposed to paid to him as per settlement. Further, he stated that he has no objection to keep his mother with him at his home if his brother stops to interference in internal matter of his house.

9. That, as per enquiry conducted so far, it is evident that petitioner has been thrown out from the house by his younger son Vishal & his wife. She is residing with her Mausi in Samaypur , Delhi. As per settlement, Petitioner is being paid an amount of Rs. 4-5 thousand per month by her elder son Bharat Bhusan but she is not willing to live with him. Younger son of the petitioner i.e. Vishal is not keeping his mother now but he wants to keep her at his home on some terms & conditions.

10. However, undersigned is ready to abide by any further directions passed by the Hon'ble Delhi High Court." 5.

application seeking restoration of rights in the concerned property is already been preferred which is pending before the Learned Single Judge. 6.

Respondent no. 1 i.e. Vishal, appears in person and submits that he is ready to abide by the undertaking given by him as noted hereinbefore and further submits that the house comprises of 2 floors and he along with his family is residing at the ground floor and petitioner will stay on the first floor. He further submits that no interference in her peaceful possession shall be caused by him.

In these circumstances, SHO, P.S. Samaypur Badli is directed that one beat constable may be deputed on a daily basis to enquire about the well-being of the petitioner.

Respondent no. 2, Bharat Bhushan, present in the Court today and submits that he will not visit the premises of respondent no. 1 where the mother is staying and in case, if any, assistance is required, respondent no. 2 will send his family members to provide necessary assistance to the mother. 9.

In view of the above, the present petition is disposed of in the aforesaid terms.
