This Court, in a catena of decisions, has maintained a consistent view that the mere presence/location of the Head Offices of certain respondents being situated within the territorial jurisdiction of this Court would not confer the requisite jurisdiction on this Court over the controversy. A bare perusal of the facts of the case postulates that the petitionerinstitute is situated in the State of Uttarakhand and the consequential outcome of the petitioner-institute's request for an increase in PG seats would also be realised in the state of Uttarakhand. 3.

As reiterated in various decisions, the pertinent factors in determining the jurisdiction of the dispute would be the material, essential, and integral cause of action.

In view of the aforesaid, learned senior counsel appearing on behalf of the petitioners seeks to withdraw the instant writ petition with a liberty to make a representation to the respondents and in the meantime, to also approach respondent No.1 for redressal of her grievances. 4.

She also seeks liberty to pursue a second appeal under the extant regulations, which is pending before respondent No.1. Leave and liberty, as prayed for, is granted.

It is directed that if the petitioner makes a representation to respondent No.1, let the same be considered and decided, strictly in accordance with law, and let the pending appeal of the petitioners be also disposed of by respondent No.1 with due expedition. 6.

In any event, the leave and liberty granted to the petitioner, to make a representation or to file an appeal under the extant regulations, shall not be construed that the Court has invoked its jurisdiction in adjudicating the controversy involved.

It is to be further noted that in case the petitioner is aggrieved by any decision to be taken by the respondent(s), the remedy against such decision would lie before the jurisdictional High Court.
