This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking directions to the Respondents to remove the alleged illegal encroachment from the Gram Sabha Rasta in Khasra No. 257 situated in village Rawta, Delhi, amongst other directions.

The grievance of the Petitioner is that some residents of village Rawta have encroached upon the Public Rasta in Khasra No.257 in village Rawta, Delhi and constructed houses on public property. of those persons who have also encroached upon the property of the Petitioner, i.e. Khasra No.330, which is adjacent to Khasra No.257. There are some litigations already pending of the alleged encroachers challenging the order passed by the Revenue Assistant/SDM, Najafgarh. 3.

Learned counsels, as above, accept notice on behalf of the respective Respondents.

Learned counsel for Respondents No.1 to 3, who appears on advance copy of the petition, on instructions, submits that no complaint has been received so far by the District Magistrate, South-West District and without getting into this controversy, on instructions, submits that this writ petition will be treated as a representation and the grievance of the Petitioner will be looked into.

Accordingly, this writ petition is disposed of without getting into the merits of the case directing the Respondents to look into the grievance of the Petitioner flagged in the writ petition and take a decision within eight weeks from today in accordance with law. Needless to state in case of any surviving grievance, Petitioner will be at liberty to take recourse to legal remedies.
