A Petition under Section 528 BNSS has been filed on behalf of the Petitioner seeking quashing of the FIR No.46/2020 dated 13.02.2020 under Section 279/338/304A IPC registered at Police Station Safdarjung Enclave. 4.

As per the Complaint the deceased Ramesh after finishing his duty along with his friends was going towards his house via Ring Road. When they reached at Ring road, under Fly Over, Sarojini Nagar Red Light, a car driven by the Petitioner came and hit Ramesh, because of which he fell on the road and blood started oozing from his head and mouth. The car was stopped by the public persons and the Petitioner was handed over to the Police. The injured Ramesh was taken to AIIMS Hospital. Ramesh thereafter succumbed to his injuries. Respondent No.6 Kush also received injuries in the accident. An FIR No.46/2020 dated 13.02.2020 under Section 279/338/304A IPC registered at Police Station Safdarjung Enclave in regard to the incident against the Petitioner herein. 5.

It is submitted that vide MOUs dated 15.11.2025 and 18.11.2025 the petitioner and the respondents have already sorted out their all differences with the intervention of their respective persons and they have left no grudge or grievance against each other in any manner whatsoever. The Respondents No.2 to 5 got Rs.13,10,950/- as compensation from MACT. In addition, the Petitioner has also paid Rs.8.5 laks to Respondent No.2 Rani wife of late Shr. Ramesh Kumar towards full and final Settlement. Respondent No.6 Kush has been given Rs.3,000/-. Therefore, the Petition be quashed. 6.

The complainant is present in the Court and submits that the matter stands settled with the accused/Petitioner. The Respondents have no objection if the FIR is quashed against the petitioner, on account of the settlement already arrived at between the parties. 7.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 8.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR No.46/2020 dated 13.02.2020 under Section 279/338/304A IPC registered at Police Station Safdarjung Enclave with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner herein.
