in Office Memorandums dated 31.10.2025, whereby the bid of the petitioner has been declared to be non-responsive as per certain clauses of the RFP. Learned counsel for the respondent no.2-Tendering Authority on instructions, has stated that the financial bid in relation to the subject tender has yet not been opened and further that the representation made by the petitioner challenging the decision declaring its bid to be non-responsive shall be considered and decided in accordance with law before opening up of the financial bids. 3.
The writ petitions stand disposed of in the terms of the statement made by the learned counsel for respondent no.2.

We make it clear that we have not made any observation as to the merit of the claim of the respective parties. We further direct that the decision to be taken on the representation preferred by the petitioner in both these matters shall be immediately communicated to the petitioner well in advance before opening up of the financial bids.
