O R D E R

% 13.04.2018 Ms.Monika Arora, learned counsel for respondent no.1 submits that the counter affidavit is ready. She, however, submits that in exercise of power under the proviso to clause 9 sub clause (III) of the Post Graduate Medical Education Regulations 2000, the Union of India has taken a considered decision not to lower the percentile for S.C or S.T. candidates.

A copy of the decision has already been provided to the learned counsel for the petitioner.

At this stage, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to challenge the said decision of respondent no.1 in accordance with the law. Leave as prayed for is granted.

The petition accordingly dismissed as withdrawn with the liberty as prayed for.

Needless to say, as the writ petition is being dismissed as withdrawn, in view of the specific decision taken by the respondent no.1 not to lower the percentile for S.C/S.T. candidate for the academic year 2018-19, the interim order dated 03.04.2018 would no longer survive.
