% 05.04.2018 By this petition, the petitioner seeks extension of parole on the ground that his brother is suffering from cancer.
Petitioner was granted parole by Govt. of NCT of Delhi for a period of four weeks for looking after his children, to arrange for their school fees and to maintain social ties. The said parole period is coming to an end tomorrow, that is, on 6th April, 2018.
Petitioner has filed the present writ petition which came up before this Court on 4th April, 2018 seeking extension of parole to arrange the school fees for the children and arrange funds for treatment of cancer of his younger brother.
Status report and nominal roll have been handed over and are taken on record.
W.P.(CRL) 941/2018
As per the status report the petitioner who is suffering from cancer is the cousin brother of the petitioner and the family of the cousin brother comprises of his wife, his real brother and other relatives. The petitioner has availed parole for a period of four weeks on the ground that he has to take care of his children and to arrange fund for school fees.
A perusal of the nominal roll reveals that petitioner is being granted regular furloughs and paroles. This year itself petitioner has been granted furlough for a period of two weeks from 20th February, 2018 followed by parole for a period of four weeks from 8th March, 2018. Considering that the person who is suffering from cancer is not the real brother, there are other family members in the house to look after him and the petitioner has already availed a parole and a furlough in this year, this Court finds no ground to extend the period of parole. Petition is dismissed.
