$~18 * IN THE HIGH COURT OF DELHI AT NEW DELHI + CRL.M.C. 1008/2017 MANMEET SINGH & ANR ..... Petitioners Through Mr. Rizwan Ahmad, Adv.

versus STATE & ANR ..... Respondents Through Mr. G.M. Farooqui, APP with SI Rawat Singh, P.S. Khyala.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 12.09.2017 It is submitted that the petitioner No.1 (accused) and respondent No.2 (complainant) have started living together after resolving their differences. Therefore, FIR No.368/2016 under Sections 323/354/354B/34 IPC registered at police station Khyala on the complaint of respondent No. 2, which is at the investigation stage, may be quashed. Petitioner No.1 and respondents no. 2 are present in Court along with their counsel and have been identified by SI Rawat Singh, P.S. Khayala. He submits that respondent No. 2 is not willing to pursue the FIR since she is living in her matrimonial home without any problems inasmuch as respondent No.2 is blessed with the second child in the month of June 2017. Keeping in view

that husband and wife have resolved their differences and have started living together, in my opinion, no fruitful purpose would be served to keep the criminal proceedings pending. In the interest of justice, FIR No.368/2016 under Sections 323/354/354A/34 IPC registered at police station Vivek Vihar which is at the investigation stage, is quashed. The petition is disposed of in the above terms. Dasti.
