% 09.04.2018 1.

Petitioner seeks quashing of FIR No.192/2012 under Sections 354/323/341 IPC Police Station Begum Pur, based on a Settlement. 2.

The subject FIR emanates out of a dispute between the neighbours consequent to parking of vehicles. 3.

With the intervention of family members, well wishers and respectable elder members of the Society, the parties have amicably settled their disputes.A Compromise Deed dated 01.03.2018 has been executed between the parties.

4.

Respondent No.2 is present in Court in person, represented by Crl.M.C.1699/2018

counsel and is identified by the Investigating Officer. She confirmsthat the parties have arrived at a Settlement with a view to maintain peace and harmony in the locality and further submits that she does not wish to press her complaint any further.

5.

In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable elder members of the Society with a view to restore peace and harmony between them and a Compromise Deed dated 01.03.2018 has been executed between the parties, and further respondent No.2 does not wish to press her complaint any further, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6.

Accordingly,FIR No.192/2012 under Sections 354/323/341 IPC Police Station Begum Pur, and the consequent proceedings emanating therefrom are hereby quashed.
