O R D E R

% 16.05.2018 By this petition, the petitioner seeks first spell of furlough and also challenges the communication dated 23rd November, 2017 declining grant of furlough to the petitioner being ineligible to seek furlough. The ground of rejection was that the petitioner had not earned 03 AGCR's which would entitle him for grant of furlough.

Further as per the nominal roll of the petitioner placed on record, a punishment was awarded to the petitioner on 25th June, 2015 pursuant to recovery of mobile phone from the barrack of the present petitioner. Petitioner had also filed an application before the Hon'ble Jail Visiting Judge seeking modification of that order, however, the said application has W.P.(CRL) 933/2018

since been dismissed and held that any application for furlough by the petitioner would be considered after 1st July, 2018. Thus the petitioner cannot be granted furlough till 1st July, 2018. Petition is dismissed.
