The present bail application is filed seeking grant of regular bail in FIR No.311/2019 dated 16.10.2019, registered at Police Station Crime Branch for offences under Sections 20/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act').

It is pointed out that the applicant is in custody since 13.01.2023 in the present FIR and also in the FIR No. 205/2019 registered under Sections 20/29 of the NDPS Act and Section 174A of the Indian Penal Code, 1860. The bail applications filed by the applicant on earlier occasions in both the FIRs were disposed of vide order dated 01.05.2024 on the applicant withdrawing the same.

The order dated 01.05.2024 passed by this Court was challenged by the applicant before the Hon'ble Apex Court in SLP (CRL.) 49255/2024.

The learned counsel for the applicant states that the said SLP was filed only challenging the order to the extent it relates to the FIR No. 205/2019.

The Hon'ble Apex Court by order dated 12.11.2024 disposed of the SLP granting liberty to the applicant to file bail application afresh before the learned Special Court after completion of six months. The circumstances in regard to the present FIR are also similar i.e., the applicant is taken into custody in both the FIRs on the same date and the charges in both the cases are yet to be framed.

The case of the prosecution is that the applicant had been absconding and had also been declared proclaimed offender which led to delay in trial.

Be that as it may, the Hon'ble Apex Court had granted liberty to the applicant to file bail application afresh before the learned Special Court concerned after completion of six months. The present bail application is therefore disposed of with liberty to the applicant to file the bail application afresh before the learned Special Court after completion of six months from 12.11.2024. 8.
Needless to state that as and when any such application is filed, the same is directed to be considered on its own merits and in accordance with law without being influenced by the orders passed on earlier occasions.

The present application is dismissed with the aforesaid observations. Pending application also stands disposed of.
