Applicant seeks anticipatory bail in FIR No. 57/2025 dated 10.01.2025, registered at PS New Ashok Nagar, for commission of offences under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). 2.

The case pertains to recovery of 210.5 gms of heroin from one Amir Shah. On interrogation, Amir Shah disclosed the name of the applicant claiming that the heroin was supplied by him and it is in the abovesaid background of the facts that the Investigating Agency issued notice to him for his participation in the investigation.

Initially, he was granted interim anticipatory bail by the Court of Sessions but thereafter such application has been dismissed. 4.

When the present application was taken up by this Court on 08.01.2026, this Court had permitted the applicant to join the investigation. 5.

IO is present in Court and submits that after the abovesaid directions also, he has joined the investigation and his statement has also been recorded. 6.

in nature and keeping in mind overall facts of the case, the interim order dated 08.01.2026 is hereby made absolute and it is directed that the applicant would keep on assisting the Investigating Agency and would join the investigation as and when so directed and in the event of his arrest, he be released on bail by the concerned SHO/IO/arresting officer, on his furnishing personal bond and surety bond in a sum of Rs.25,000/- each.

Needless to say, if the applicant does not join the investigation despite specific intimation given in writing in advance, the prosecution would be at liberty to approach this Court for seeking cancellation of bail. 8.

The application stands disposed of in aforesaid terms. 9.

Pending application also stands disposed of.
