The accused/applicant seeks regular bail in case FIR No.17/2018 of PS Naraina for offence under Section 307/186/353/333/174A/34 IPC and Section 25/27 Arms Act.

Broadly speaking, the allegation against the accused/applicant is that he was driving the car with co-accused persons and on being stopped by a police party followed by the police official showing his identity card, the coaccused open fired at police party, thereby injuring one Sub Inspector, after which the accused/applicant sped away the car with others. The incident occurred in 2018 and the accused/applicant succeeded in evading arrest and was declared a Proclaimed Offender on 15.05.2024, after which he got arrested. was identified by the said Sub Inspector who had been shot at. 3.
After addressing partly, learned counsel for accused/applicant, on instructions, seeks permission to withdraw this bail application with liberty to file afresh before the trial court, subsequent to the testimony of the said Sub Inspector who had identified the accused/applicant in TIP. 4.
As requested, the bail application and the accompanying application are dismissed as withdrawn with liberty as sought. As further requested, the learned trial court shall make a formal request to the FSL to expedite their report so that the said Sub Inspector can be completely examined at the earliest.
