The appeal is restored to its original position. 2.

The application stands disposed of.

RSA No.121/2017 & CM No.14990/2017 (for stay). 3.

This order is in continuation of the earlier order dated 24th September, 2018.

Mr. Vinod K. Gandhi, Advocate for the respondent/plaintiff along with Pyare Lal, father of the respondent/plaintiff Jeevan Lal appears and has left it to this Court to grant appropriate time to the appellant/defendant to vacate the shop. 5.

The counsel for the appellant/defendant seeks one year's time to vacate the shop.

The aforesaid request is found to be reasonable. 7.

Though the appeal is dismissed as not pressed but the appellant/defendant is granted one year's time i.e. till 31st December, 2019, to vacate subject shop. 8.

Accordingly, the judgment and decree impugned in this appeal be not executed till 31st December, 2019.

The appeal is disposed of.
