Learned counsel for the respondent, in response to the order dated 20th January 2026, states that the amount of Rs.21,00,000/- is already received as the cheque issued by the appellant is encashed. 2.

A joint request is made by the learned counsel appearing for the respective parties that the appeal may be disposed of in terms of the settlement arrived at between the parties.

According to learned counsel for the appellant, the amount of Rs.21,00,000/- is agreed to be towards the full and final settlement of the claim of the respondent.

The aforesaid proposition is not disputed by learned counsel for the respondent.

Since the issue is not adjudicated on merits in the appeal, it shall be open for the appellant to claim refund of the Court fee in accordance with the law.
