After hearing both the parties, this Court is of the opinion that since both the parties have already nominated their respective nominee Arbitrators and the Tribunal is likely to be constituted, as and when the Tribunal is constituted, this application be treated as one under Section 17 of the Arbitration & Conciliation Act.
