O R D E R

The present writ petition has been filed seeking directions to the respondent nos. 1 and 2, to forthwith take action against the unauthorized construction being carried out by respondent nos. 3 to 6 at the property bearing Nos. G-8/36, G-8/40, G-8/42 and G-8/46, Pocket G-8, Sector-15, Rohini, Delhi.

Learned counsel appearing for the petitioner has drawn the attention of this Court to the photographs attached with the present writ petition as The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Annexure A-2, to submit that encroachments have been made on the public land.

Responding to the present writ petition, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD") submits that a complaint with regard to the unauthorized construction and encroachment was received on 20th November, 2025. Thereafter, the properties in question were inspected on 21st November, 2025 and on the same date itself, the property has been booked.

She further submits that Show Cause Notices dated 21st November, 2025, have also been issued to the owners/occupiers of the respective flats. 5.

At this stage, learned counsel appearing for the petitioner submits that there is ongoing construction in the property in question. 6.

Considering the submissions made before this Court and in view of the fact that the MCD has already booked the unauthorized construction in the properties in question, and has already issued Show Cause Notices with regard thereto, it is directed that the MCD shall take requisite action after following the due procedure, in accordance with law. 7.

Further, the MCD shall ensure that there is no further unauthorized construction in the properties in question.

The Station House Officer ("SHO") of the local police station is enjoined upon to ensure that no further unauthorized construction takes place in the properties in question and also ensure that requisite assistance is provided to the MCD, as and when action is sought to be taken. 9.

Before taking any action, the MCD shall ensure that the owners/occupiers of the flats in question, are granted time for hearing as well.

In case, any party is aggrieved by any action or non-action on the part of the MCD, their rights to seek remedies in accordance with law, are reserved.

Rights and contentions of the parties are left open. 12.
