The present writ petition has been filed seeking directions to respondent no.1, to de-seal the property bearing House No. D-47, Basement and Ground Floor, situated at Mansarover Garden, Kirti Nagar, New Delhi. 2.
Learned counsel appearing for the petitioner submits that the petitioner is the erstwhile tenant who has already vacated the premises. It is submitted that petitioner was earlier running a school under the name and style of "G.D. GOENKA LA PETITE", in the basement and ground floor of the property in question. Thus, it is submitted that the petitioner has already left the property in question on 30th June, 2025. Further, it is submitted that the Municipal Corporation of Delhi ("MCD") has sealed the basement of the property vide order dated 15th April, 2025. Thus, it is submitted that the premises be de-sealed for a limited period, so that the articles, list of which is given in paragraph 6 of the present petition, is allowed to be removed.

Learned counsel appearing for respondent nos. 2 and 3 submits that respondent nos. 2 and 3 are the owners of the property in question. It is submitted that only basement of the property in question has been sealed and that ground floor of the property has not been sealed. 5.
The aforesaid fact is confirmed by learned counsel appearing for the MCD, who submits that only the basement of the property in question has been sealed.

Learned counsel appearing for respondent nos. 2 and 3, owner of the property in question submits that he has no objection if the petitioner is allowed to remove his goods from the ground floor and first floor of the property in question.

At this stage, learned counsel appearing for the respondent no.1-MCD submits that the petitioner is required to submit an Indemnity Bond with the MCD, in order to indemnify the MCD against any damage or cause that may arise, during the time of shifting.

Accordingly, considering the submissions made before this Court, it is directed that the basement of the premises in question shall be de-sealed by the MCD on 10th December, 2025. The premises shall be de-sealed at 10:00 AM and shall be re-sealed again at 06:00 PM on the same date. 9.
The owners of the premises in question, i.e., respondent nos. 2 and 3, shall also be present at the time of de-sealing of the premises by the MCD. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Upon the MCD de-sealing the premises, for one day, as aforesaid, the petitioner shall be allowed to take out all its goods. At the time of taking out the goods, the petitioner shall make an inventory of all the goods taken out, which shall be duly signed by the respondent nos. 2 and 3 or their authorized representative, in the presence of the MCD.

The said inventory shall be kept by the MCD for its own record, with copies to the petitioner as well as respondent nos. 2 and 3. 12.
Further, the petitioner shall also comply with other directions as issued by the MCD, and the compliances as required shall be completed by the petitioner before 10th December, 2025, the day on which de-sealing would take place.
