Under this compliance affidavit, besides other submissions, the respondents have taken the following position in paragraph no.11. "The said exit permit application dated 25.12.2025 is still pneing in this office for want of NOC from Hon'ble Trial Court now and the foreign national has been intimated via e mail dated 23.01.2026 to seek an NOC to ravel abroad from the Hon'ble Trial Court through his counsel in order to enable this office to decide upon his exit permit application. In the event of the NOC being not granted by the Hon'ble trial Court, the department is ready to provide visa extension to the foreign national under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. appropriate category in view of his ongoing criminal case. The copy of the e mail dated 23.01.2026 sent to the petitioner by this office is annexed as Annexure R-3 for kind perusal." 3.

In view thereof, learned counsel for the petitioner submits that the petitioner will undertake necessary steps for obtaining the NOC from the concerned Court. If the petitioner does so, and the NOC is granted, let the respondents to take appropriate decision for the grant of exit permit to the petitioner.

In any case, if the NOC is not granted, the petitioner shall be at liberty to file an application for extension of the visa. There does not seem to be any impediment in considering such an application in accordance with the extant rules.
