1. The present petition under Section 24 read with Section 151 of the Code of Civil Procedure, 1908 has been filed on behalf of the petitioner for transfer of CS (COMM) 110/2023 from the Court of learned DJ(COMM)-01, Shahdara, Karkardooma Courts, Delhi to learned DJ(COMM)-03, Shahdara, Karkardooma Courts and club the proceedings of the said suit with CS(COMM)625/2024 in the transferee Court.
2. Upon the notice being issued, learned counsel for the respondent submits that he has no objection for the clubbing of the matter. However, he submits that both the matters may be heard by learned DJ(COMM)-01, Shahdara, Karkardooma Courts, Delhi. 3. Without going into the opposite averments, let CS(COMM) 110/2023 and CS (COMM) 625/2024 pending before the learned DJ(COMM)- 01, Shahdara, Karkardooma Courts, Delhi and learned DJ(COMM)- 03, Shahdara, Karkardooma Courts, are withdrawn and assigned to the learned DJ(COMM)-02, Shahdara, Karkardooma Courts, Delhi for trial in accordance with the law. The transferor Courts are directed to send the entire record of the matter to the transferee Court.
4. Copy of the order be sent to the learned DJ(COMM)-01, 02 and 03, Shahdara, Karkardooma Courts, Delhi, for necessary information compliance.
5. Accordingly, the present petition alongwith pending application stands disposed of.
