The learned proxy counsel for the petitioner seeks an adjournment on the ground that the learned counsel for the petitioner is indisposed. However, this Court would note that the petitioner has not been able to serve the respondent till date. There is no reason as to why the matter should be kept on Board and accordingly It is liable to be dismissed for nonprosecution. However, in view of the exigency of the learned counsel for the petitioner, renotify on 26.02.2019." In view of the above, the petition is dismissed for non-prosecution as well as in default.
