The present writ petition has been filed seeking directions to respondent no. 1, to take action against the illegal construction, being carried out by respondent no. 3 in the property bearing No. C-3/140, Brijpuri Shahdara, Delhi-110094, without obtaining any Sanctioned Building Plan. 2.

It is submitted that petitioner is the actual owner of the property in question, qua which, the petitioner has already initiated civil proceedings. 3.

petitioner has filed a suit being CS No. 350/2025, titled as "Uzma Versus Suraj Kumar", against the respondent no. 3 herein, for permanent injunction and for declaring the documents executed in favour of respondent no. 3, as null and void.

Responding to the present petition, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD"), has handed over copy of a Status Report, which is taken on record. 5.

As per the said Status Report, the unauthorized construction in the property already stands booked on 26th November, 2025. 6.

Further, a Work-stop Notice has also been issued to the Station House Officer ("SHO"), Police Station ("PS") Dayalpur, Delhi. Moreover, sealing proceedings have already been initiated.

Accordingly, in view of the submissions made before this Court, it is made clear that this Court in the present writ proceedings shall not go into the issue as regards the title or ownership of the property in question. However, considering the submissions as regards unauthorized construction being carried out in the property in question, the MCD is held bound to take a time bound action, against the unauthorized construction in the property in question, in accordance with law, after following the due procedure. 8.

In case, any party is aggrieved by any action or non-action on the part of the MCD, their right to seek remedies, in accordance with law is reserved. 9.

With the aforesaid directions, the present writ petition is accordingly disposed of.
