Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (erstwhile Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioner, Rishabh for quashing of FIR No. 911/2021 dated 06.11.2021 under Section 380 and 411 of the Indian Penal Code, 1860 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
(hereinafter referred to as 'IPC') registered at Police Station Burari and all the consequential proceedings emanating therefrom, in terms of the Order dated 29.04.2025.

On advance Notice, learned ASC (Crl.) has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that on 06.11.2021 at around 04:30 pm, a boy from the neighbouring house, broke into the house of the Respondent No. 2 and stole the phone of his father, which was retained on the table. Thereafter, the family members of the Respondent No. 2 woke up and caught the Petitioner at home itself and the Samsung M-30 blue colour phone of the Petitioner's father, got recovered from the pocket of his pants. 7.
On the Complaint of the Respondent No.2/Complainant, FIR No.911/2021 dated 06.11.2021 under Section 380 and 411 of IPC, got registered at Police Station Burari.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 29.04.2025. In the Settlement, it was inter alia settled between the parties that they shall not file any criminal cases/complaints pertaining to the alleged offence in any Court of law.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the FIR is quashed.

The parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 911/2021 dated 06.11.2021 under Section 380 and 411 of IPC. registered at Police Station Burari and all the consequential proceedings emanating therefrom are quashed 12.
The Petition is disposed of accordingly.
