The petitioner has filed the present petition, inter alia, impugning an order dated 14.11.2024 (hereafter the impugned order) passed by the learned Debts Recovery Tribunal-II (hereafter the DRT) staying the proceedings before the Recovery Officer.

The petitioner is essentially aggrieved by the stay of the proceedings, as the same interdicts the proceedings to secure the possession of the property purchased by the petitioner in an auction conducted by the Recovery Officer.

Concededly, the petitioner was not impleaded in the miscellaneous application filed as MA No. 185/2024 in OA No. 58/2016 in which the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. impugned order was passed.

Mr. Vacher, the learned senior counsel for respondent nos. 2 and 4 submits that an application for impleading the petitioner has already been filed which is pending before the learned DRT, which is now listed on 30.01.2025. He submits that in the first instance the petitioner can agitate his grievance before the learned DRT.
In so far as the interim order is concerned, the parties have agreed that the same be vacated as it was passed without hearing the petition.

The learned counsel for the petitioner is also satisfied with the said suggestion.

In view of the above, the impugned order to the extent it stays the proceedings before the Recovery Officer, is set aside. 7.
The petitioner shall appear before the learned DRT on 30.01.2025 for further proceedings.

The petition is disposed of in the aforesaid terms. 9.
It is clarified that this court has not examined merits of the controversy as is pending before the learned DRT and the same will be decided uninfluenced by any observations made in this order. 10.
We also clarify that all rights and contentions of the parties are left open.
