This appeal was argued at length.

During the course of arguments learned counsels for the parties stated that this appeal can be disposed of by a consent and compromise order. 2.

Learned counsel for the respondents has taken instructions from respondent No.3 Mr. Amit, who is present in the court. It is agreed that respondents will pay to the appellant a sum of Rs.1,40,000/- in full and final settlement within six months from today. On receiving of this amount of Rs.1,40,000/- from the respondents, judgment and decree of the trial court dated 01.03.2011 will stand satisfied, but if the payment is not made within six month to the appellant of the aforesaid amount of Rs.1,40,000/-, then, this appeal will stand allowed and judgment of the trial court dated 01.03.2011 will stand revived by setting aside the judgment of the first appellate court dated 08.04.2013.
