The present petition has been filed under Section 11(4)(a) of the Arbitration and Conciliation Act, 1996 by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes between the parties under a Contract dated 30.05.2020.

Material on record indicates that a Contract Agreement dated 30.05.2020 was entered into between the parties for execution of project which was awarded to the Petitioner by the Respondent for 'Rehabilitation and Upgradation of Dergaon Town to 4 laning from Km. 426.800 to km 437.400 km on NH-37 in the state of Assam on EPC basis'. 3.
Clause 26.3 of Contract Agreement contains an arbitration clause, which was invoked by the Petitioner on 11.08.2025, whereby a nominee arbitrator has already been appointed.

Learned Senior Counsel appearing for the Respondent states that the Respondent has also appointed its nominee arbitrator. A letter dated 08.12.2025 has been produced in Court intimating the nominee arbitrator of the Respondent having been appointed.

The nominee Arbitrators are directed to now appoint the Presiding Arbitrator and commence the Arbitration proceedings in accordance with law.
