The petitioner is seeking initiation of contempt proceedings against the respondent for the wilful defiance of the order dated 01.08.2024 in EFA(OS) (COMM) No.2/2023, whereby on settlement made by the parties, the respondent undertook to make a payment of ₹1.89 crores towards full and final settlement of the dues of the petitioner. It appears that the respondent has not complied with the undertaking and has not made the payment in accordance with the directions dated 01.08.2024.

Learned counsel for the respondent is present on advance notice and he submits that there arose delays of few days here and there in making of the payment and it is stated that in any case the payment has been made of the instalments as per the MoU till March, 2025. The said position is accepted by the learned counsel for the petitioner present.
