Counsel enters appearance on behalf of the defendant and submits that the defendant has discontinued the use of the bottles bearing the impugned packaging and trade dress. She further submits that the defendant would have no objection to a decree of permanent injunction being passed against the defendant.

Accordingly, a decree of permanent injunction is passed in terms of prayer clauses 71 (i), (ii) and (iii) of the plaint. 3.

Counsel for the plaintiffs does not press for the remaining reliefs prayed for in the plaint.

Decree sheet be drawn up accordingly.
