The Applicant is an undertrial prisoner in FIR No. 188/2019 dated 20th May, 2019, registered at P.S. Vivek Vihar, under Sections 302/34 of Indian Penal Code, 18601. He seeks interim bail to attend the wedding of his niece on 7th December, 2025, with attendant functions scheduled from 5th December, 2025. The fact that the marriage has been fixed stands verified, as noted in the impugned order dated 28th November, 2025, passed by the Trial Court.

custody parole with adequate security from 5:00 PM to 10:00 PM for the marriage functions on 7th December, 2025.

Counsel for the Applicant, however, submits that attending the marriage function while on custody parole would not be commensurate with the occasion, as the ceremony would take place in the presence of police personnel and while the Applicant remains in custody. It is submitted that limited interim bail may instead be granted for the purpose of attending the marriage, as the Applicant has brought up his niece and shares a deep emotional bond with her.

This Court has, by a detailed order dated 30th April, 2025, dismissed the Applicant's bail application, which decision was not interfered with by the Supreme Court. Thereafter, the prosecution witnesses have been examined, and presently the examination-in-chief of PW-7, Shashi Bala, wife of the deceased, has been recorded and partly cross-examined. The matter is now listed for further examination on 13th December, 2025. 5.
The Applicant has never been released on interim bail earlier and has been in custody for more than six and a half years. 6.
Considering the aforesaid circumstances and purely on humanitarian grounds, the Applicant is granted interim bail from 5th December, 2025 to 8th December, 2025, upon furnishing a bail bond in the sum of INR 25,000/- with two sureties of the like amount, to the satisfaction of the concerned Jail Superintendent / Trial Court / Duty MM, subject to the following conditions: (a) The Applicant shall duly surrender on or before 8th December, 2025 before the Jail Superintendent/Trial Court/ Duty MM; (b) The Applicant shall not leave the NCT of Delhi under any circumstances during the period of interim bail without permission of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(c) The Applicant shall not contact the victim or any of her family members; (d) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case in any manner;
(e) The Applicant shall provide the address where he would be residing during the period of interim bail and shall not change the said address without informing the concerned IO/SHO;
(f) The Applicant shall furnish his mobile number to the concerned IO/SHO upon release and shall keep his mobile phone switched on at all times; (g) The Applicant shall contact the concerned SHO on a daily basis during the period of interim bail and confirm his location; (h) The Applicant shall not commit any offence during the period of his release.

With the above directions, the application stands disposed of along with pending application.
