The Court had made it clear that in the event the status report and affidavit, as directed, were not filed within the time granted, the Divisional Commissioner shall remain present before the Court, either personally or through video conference. Accordingly, this Court, by order dated 24th February, 2026, taking note of non-compliance, issued the following directions:
"1. Counsel for the Petitioner points out that the order dated 26th May, 2025 has not been complied with till date. It is also noted that the present proceedings arise out of directions issued by this Court as far back as in 2015.
2. In view of the above, the Divisional Commissioner is directed to remain present before this Court on the next date of hearing.
3. Copy of the order be also served on Mr. Sameer Vashisht, Standing Counsel for GNCTD, to ensure presence of Divisional Commissioner and compliance with the directions of this Court.
4. Re-notify on 29th April, 2026."

In compliance with the aforenoted directions, a status report has been filed, a copy whereof has been supplied to the Petitioners, enclosing therewith an order dated 27th April, 2026. In light thereof, Mr. Kundan Kumar Mishra, counsel for the Petitioners, confirms that the directions issued by this Court stand complied with. However, he submits that he has a grievance against the decision rendered.

Mr. Sameer Vashisht, Standing Counsel for GNCTD, has also explained the reason for non-appearance of the Divisional Commissioner and has sought exemption from personal appearance in CM APPL. 28900/2026.

For the grounds and reasons stated in the application and as explained by Mr. Vashisht, the personal presence of the Divisional Commissioner is exempted for today, particularly noting that the order dated 24th February, 2026 stands complied with.

This writ petition seeks directions to Respondent No. 3 i.e., the Deputy Commissioner, North-West, Kanjhawala, Delhi, for expeditious disposal of Appeal No. 115/DC/NW/2015, titled Sh. Jai Pal Singh & Ors. v. DDA & Ors., along with the tagged appeal filed by DDA, being Appeal No. 82/DC/NW/2015.

In light of the status report filed in CONT.CAS(C) 1837/2025 and the order dated 27th April, 2026 enclosed therewith, the directions sought in the present petition stand complied with. Accordingly, the writ petition is disposed of with liberty reserved in favour of the Petitioners as noted above.
