This hearing has been done through hybrid mode. I.A. 1656/2024 ( for withdrawal of the petition) in CS(OS)-1705/2014 2.

The present application has been filed by the Petitioner seeking withdrawal of the suit in view of the insolvency proceedings that have been commenced against the Defendant under Section 95 (1) of the Insolvency and Bankruptcy Code, 2016 before the NCLT Principal Bench New Delhi being (IB)-156 (PB)/2021, titled State of Bank of India v. Mrs. Aarti Singhal.

For the reasons stated in the application, the suit is dismissed as withdrawn. Full court fee be refunded to the Plaintiff. Plaintiff is permitted to file its claims before the NCLT.

The next date shall stand cancelled.
