The Applicant is an under-trial prisoner in FIR No. 116/2021, registered under Sections 302/307/353/186/34 of the Indian Penal Code, 18601 and Section 25/27 of the Arms Act 1959.2 The Applicant seeks interim bail on account of his medical condition. 2.
By order dated 3rd December, 2025, a report from Deen Dayal Upadhyay Hospital was called for, and the State was directed to verify the medical records. The report indicates that the Applicant's surgery is scheduled for 16th December, 2025, and as per the medical opinion, a postoperative recovery period of approximately one week will be required. 1 "IPC"

As per the nominal roll, the Applicant has undergone incarceration for 4 years, 8 months and 18 days. The matter is still at the stage of trial, the next date being 8th January, 2026. As per the defence, no prosecution witness has been summoned and the FSL report is awaited. 4.
Counsel for the Applicant states that the Applicant intends to undergo the surgery at DDU Hospital itself, where he has been receiving treatment. 5.
In view of the aforesaid circumstances, purely on humanitarian and considering the medical condition of the applicant he is directed to be released on interim bail for a period of 14 days with effect from 15th December, 2025 upon furnishing a bail bond in the sum of INR 25,000/- with two sureties of the like amount, to the satisfaction of the concerned Jail Superintendent / Trial Court / Duty MM, subject to the following conditions: a.
The Applicant shall surrender before the Jail Superintendent/Trial Court/ Duty MM, on or before the expiry of 14 days from the date of release;
b.
The Applicant shall cooperate in any further investigation as and when directed by the concerned IO;
c.
The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever; d.
The Applicant shall under no circumstance leave the country of NCT of Delhi without the permission of the Trial Court; e.
The Applicant shall appear before the Trial Court as and when directed;

f.
The Applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO;
g.
The Applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times. 6.
The State shall confirm and submit a report regarding the Applicant's admission in the hospital once he is admitted. 7.
The application stands disposed of. List for compliance on 17th December, 2025.
