% 06.02.2025 After hearing detailed submissions in the matter, it transpires that the principal contention raised by Mr. S. D. Singh, learned counsel appearing on behalf of the petitioner is that the date of birth of the prosecutrix i.e., 02.11.2003, as alleged by the prosecution, is not her correct date of birth since that date of birth is arising from a certificate purportedly issued by a school in Delhi whereas the prosecutrix has also attended a school in Bihar earlier.

In the circumstances, Mr. Singh seeks leave to withdraw the present petition with liberty to file afresh for the same relief, after the deposition of all prosecution witnesses in the matter is complete, in an effort to dispute the date of birth of the prosecutrix.

The petition is accordingly disposed-of as withdrawn, with liberty as prayed-for; without expressing any opinion on the merits of the matter. Pending applications, if any, also stand disposed-of.
