Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for setting aside Order dated 29.10.2025, whereby the Petitioner‟s Application for setting aside ex-parte Order dated 20.08.2024 granting maintenance to the Respondents under Section 125 Cr.P.C. was dismissed.

Learned APP for the State appears on advance Notice. 3.

Under Section 19 of Family Courts Act, only an Appeal is maintainable against Order of the learned Family Court.

Learned counsel for the Petitioners seeks permission to withdraw present Petition with liberty to file an Appeal in terms of Section 19 of Family Courts Act.
