This is a petition under Section 528 BNSS for quashing of FIR no. 15/2016 under Section 7/10 of Essential Commodities Act, 1955, PS Bharat Nagar and the consequential proceedings arising therefrom. 2.
It is submitted that the Inspector of Department of Food and Supplies, Government of Delhi had carried out an inspection at the Fair Price Shop (FPS) of the petitioner and found that petitioner no. 2 had deviated the wheat and rice procured from the Food and Supplies Department and thus cancelled the authorization of FPS of the petitioner no. 2. 3.
Consequent to the said inspections, the present FIR was lodged against the petitioners. It is submitted that the Appellate Authority has restored the authorization of the FPS of the petitioner no. 2 while observing The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. that the beneficiaries/ration card holders have been getting the ration in full quantity and in time.

The Ld. APP appearing for the State submits that charge sheet has already been filed and the matter is listed before the Ld. Trial Court for arguments on charge and therefore, the petitioners may make their submissions before the Trial Court and contest framing of charges against them.

At this stage, Mr. Dhruv Aggarwal, Ld. Counsel who appears for the petitioners seeks permission to withdraw the petition with liberty to urge all his submission before the Trial Court at the stage of charge. 6.
The statement made by the Ld. Counsel is taken on record and petition is dismissed as withdrawn with liberty as prayed for.
