This is a petition filed under Section 483 of BNSS,2023 seeking grant of regular bail in FIR No. 574/2024 dated 18.12.2024 under Sections 115(2)/333/351(2)/3(5) of BNS, 2023 registered at Police Station Prashant Vihar.

As per the FIR, on 31.10.2024, there was an altercation between the petitioner and the complainant as a result of which the complainant made a police complaint. Thereafter, on 03.11.2024, Praveen Chaudhary along with 3 other persons including the petitioner entered into the office of the complainant and physically beat him and threatened to kill him. Hence, the present FIR.

It is further stated that the petitioner had never threatened the complainant. In addition, the petitioner regrets and undertakes to never repeat the actions.

Lastly, it is stated that the nature of injury suffered by the complainant is simple.

I have heard learned counsels for the parties as well as the complainant.

As per the Nominal Roll dated 20.01.2025, the petitioner has been in custody for a period of 1 month 12 days. The nature of injury suffered by the complainant is simple in nature. The assurance of the learned counsel for the petitioner is taken on record and in case of any other similar offence, the respondent shall be at liberty to file an application seeking cancellation of the order passed today. The petitioner has already been in custody for about 45 days.

For the said reasons, the petition is allowed and the petitioner is directed to be released on regular bail subject to the following terms and conditions:- a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court;

c) The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. The petitioner shall also provide his permanent residential address and in case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned IO; d) The petitioner shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court;

e) The petitioner shall not indulge in any criminal activity during the bail period;

f) The petitioner shall not communicate with, or come into contact with any of the prosecution witnesses, or any member of the victim's family, or tamper with the evidence of the case. 9.

A copy of this order be communicated to the concerned jail authorities for necessary compliance.
