Learned Counsel for the Respondent draws attention of this Court to the communications dated 04.09.2025 and 29.10.2025 sent by the Respondent to the Petitioner, to state that it is open for the Petitioner to complete the remedial work within a period of two months. He further states that the Respondent is still prepared to stand by the contents of the communications dated 04.09.2025 and 29.10.2025. 2.

Considering the above submission, this Court is of the opinion that it is implied that if Petitioner is prepared to complete the remedial works, the Respondent will not proceed ahead with a fresh tender. Learned Senior Counsel for the Petitioner states that since the Petitioner is being permitted to continue the work, at this juncture, no dispute lies between the Parties.

Needless to state, endeavour shall be made by the Petitioner to complete the work within a period of two months from today. 6.

With these observations, the Petition is disposed of as infructuous, along with pending application(s), if any.
