Heard the learned counsel for the parties.

The prayer made in this Public Interest Litigation Petition is in respect of Khasra Nos. 25/16 and 25/17 said to be comprised in Gram Sabha Land of Village Palla.

The assertion made in this Public Interest Litigation Petition appears to be that the said Khasra numbers are in fact recorded as Pond Land, which have been allotted by means of the allotment letter dated 03.11.2021 to Delhi Jal Board for construction of Waste Water Treatment Plant, which is impermissible in view of the law laid down by the Hon'ble Supreme Court in the case of Jagpal Singh & Ors. vs. State of Punjab & Ors. reported in (2011) 11 SCC 396.

The petitioner in support of his case has enclosed a copy of Khata details at page 162, which shows Khasra Nos. 25/16 and 25/17 are two separate land parcels and are recorded as pasture land. It is the submission of the petitioner, who appears in person, that in fact these Khasra plots are pond land since fairly a long time. However, there is no record to substantiate such submissions being advanced by the petitioner.

At this juncture, the petitioner prays that he may be permitted to withdraw this writ petition with liberty to file a fresh petition with appropriate pleadings.

Accordingly, this PIL petition is dismissed with the liberty as prayed for. 7.

We make it clear that any such fresh petition on the subject matter, which has been raised in this petition, will be entertained only if it is supported by relevant documents establishing that Khasra Nos. 25/16 and 25/17 were earlier recorded as pond and also the reason as to how the nature of the land from pond has been altered to pasture land.

We also make it clear that we have not made any observation on the merit of the claims of the respective parties.
