% 06.12.2017 Justice Usha Mehra,(Retd.) has submitted the declaration in accordance with Section 11(8) of the Arbitration and Conciliation Act, 1996 through the petitioner. The parties have no objection to her appointment for adjudication of the disputes as a Presiding Arbitrator. In view of the above, I appoint Justice Usha Mehra, (Retd.) as the Presiding Arbitrator for adjudication of the disputes that have arisen between the parties in relation to Railway Rake Hire Agreement dated 5th August, 2013 executed between the parties.

This appointment shall be without prejudice to the contention of the respondent that there are no disputes between the parties in relation to the above mentioned agreement. It is made clear that this issue will be adjudicated by the Arbitrator uninfluenced by any observation that I may have made in this order or in the order dated 28th November, 2017.
