% 25.04.2018 CRL.M.C. 1712/2018 & Crl.M.A.6173/2018(stay) 1.
Petitioner seeks quashing of FIR No.621/2017 under Sections 354D/509 IPC, Police Station Vasant Kunj (North). 2.
As per the FIR, petitioner, who was in the friend list of the respondent as a Facebook friend, posted objectionable material. 3.
With the intervention of the well-wishers, friends and respectable elder members of the Society, the parties have amicably settled their dispute and Settlement Agreement dated 26.03.2018 has been executed between them.
4.
Petitioner is present in Court in person. He has expressed remorse and regretted for his behaviour. He undertakes that he will not repeat this type of behaviour in future.
5.
Respondent No.2 is present in Court in person. She confirms that CRL.M.C. 1712/2018
they have arrived at a Settlement with a view to maintain peace and harmony and further submits that she does not wish to press her complaint any further.
6.
In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable members of the Society and the remorse is expressed by the petitioner for his behaviour and a Settlement has been arrived at between the parties, and further respondent No.2 does not wish to press her charges against petitioner, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
7.
Accordingly, FIR No.621/2017 under Sections 354D/509 IPC, Police Station Vasant Kunj (North), and the consequent proceedings emanating therefrom are hereby quashed, subject to the petitioner depositing costs of Rs.25,000/-, which shall be paid to the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi, within a period of two weeks from today.
