The present writ petition has been filed seeking directions to the respondent/ Election Commission of India ('ECI') to fix a date for hearing, and to register the approved name of the political party namely, "Akhil Bangiya Janata Party", prior to the expiry of the date of submission of application for allotment of common symbol under Para 10B of the Election Symbols (Reservation and Allotment) Order, 1968 (hereinafter "Election Order"), for the state of West Bengal.

Counter affidavit has been filed on behalf of the respondent/ECI, pointing out the deficiencies in the application filed by the petitioner. 2.1.

from the District Election Officer, Bankura, West Bengal ('DEO') with regard to physical verification of the affidavits submitted by the petitioner along with his application.

During the course of hearing, a communication dated 5th February, 2026 addressed by the respondent/ECI to the petitioner has been handed over in Court by counsel for the respondent. In terms of the said communication, out of the 20 members whose affidavits were verified , 12 members have denied being members of the petitioner party or having signed the affidavits.

Copy of the said communication has been handed over to the counsel for the petitioner. The same is taken on record. 4.

In view thereof, the present writ petition is disposed of while giving liberty to the petitioner to respond to the aforesaid communication. Based on the response, the respondent/ECI shall proceed in accordance with law.
