The instant petition has been filed the instant petition for the following reliefs:

"a. Issue a Writ of Mandamus directing Respondent No. 2 to 4 to provide clear road / access and remove the blockages and barricades form the road leading to the houses and shops of the petitioner association's members;

b. Alternatively, issue a writ of Prohibition, prohibiting the Respondent no.2 to 4 not to create any hindrance / obstruction in the free access / egress and ingress to the members of the petitioner association to their houses/ shops;"

Learned counsel appearing for the petitioner submits that a counter affidavit has filed by the respondents and he be granted some time to file a rejoinder.

in the petition, it appears that the dispute will have to be essentially decided by respondent nos.2 and 4 after extending the opportunity of hearing to the petitioner.

The petitioner claims to be an association that represents residents and shopkeepers of Sewa Nagar Market, New Delhi. Pursuant to the redevelopment of Sewa Nagar approved in 2016, the respondents allegedly barricaded and closed the main roads to the market. It is the case of the petitioner that such closure has severely restricted ingress and egress of residents, customers, emergency services, and has drastically affected the livelihood of shopkeepers.

The aforesaid aspects will have to be adequately considered by respondent nos.2 and 4 and an appropriate order is required to be passed. 6.

If the petitioner, thereafter, has any grievance, it shall be entitled to take appropriate recourse in accordance with law. 7.

Under these circumstances, instead of keeping the matter pending, the same stands disposed of with the following directions: i.

Let the petitioner's petition be treated to be a representation by respondent nos.2 and 4.

ii.

Let respondent nos.2 and 4 issue notice to the petitioner for making their submissions.

iii.

After hearing the representatives of the petitioner, let respondent nos.2 and 4 to pass a speaking order with due expedition.
