The present writ petition has been filed seeking directions to the respondent authorities to take action against the unauthorized construction at Plot No. 98/9, Village Kishangarh, New Delhi (hereinafter the 'subject property'), undertaken by the private respondent no.4. 2.

Counsel appearing for the petitioner submits that earlier, a petition being W.P.(C) 4935/2025, titled "Trilok Mehlawat v. Deputy Commissioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

of Municipal Corporation of Delhi and Ors.", was filed, which was disposed of vide order dated 07th November, 2025, by noting the fact that the owner/occupier of the subject property had already filed an appeal before the Appellate Tribunal Municipal Corporation of Delhi ("ATMCD"), wherein, it had been directed by the ATMCD that no coercive action shall be taken against the subject property.

Notice in the present writ petition was issued on 4th December, 2025. 4.

A status report has been filed on behalf of the respondent-MCD. 4.1.

A copy of the same has been handed over in Court today and the same is taken on record.

A copy of the said status report has also been handed over to counsel appearing on behalf of the petitioner and counsel appearing on behalf of the private respondent no. 4.

Earlier, the appeal filed on behalf of the private respondent no.4 was disposed of by the ATMCD on 13th November, 2025, remanding the matter back to MCD, with a direction that MCD shall pass a speaking order after giving a personal hearing to the private respondent no.4. 6.

Pursuant to the aforesaid order, personal hearing was granted to the private respondent no.4 on various dates and a detailed speaking demolition order was passed by MCD on 16th April, 2026.

In view thereof, it is directed that the respondent-MCD shall take appropriate action in terms of the aforesaid demolition order.

8. The concerned SHO, P.S.:Kishangarh/Vasant Kunj (North), shall provide the necessary police force to the respondent-MCD for the purpose of carrying out the demolition action.
