This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking directions to DDA to convert property bearing MIG Flat No.137-B, Block-U&V, First Floor, Shalimar Bagh, New Delhi from leasehold to freehold in the name of Petitioner. 4.

Learned counsel for DDA appearing on advance copy of the writ petition submits that till date the Petitioner has not furnished any document which shows ownership/title of the Petitioner and sans that no conversion can be carried out. It is also urged that title disputes cannot be raised in a writ jurisdiction and hence the petition is not maintainable. Respondent is right in submitting that in absence of title/ownership documents, conversion of the property cannot be carried out. 6.

At this stage, learned counsel for the Petitioner submits that an amount of Rs.40,000/- had been deposited with DDA and the same be refunded. On Petitioner furnishing proof of deposit of the said amount to Deputy Director (Land & Building), the amount shall be refunded to the Petitioner within three weeks from date of receipt of the documents, since DDA takes a stand that at this stage, conversion cannot be done. 7.
