The present petition has been filed seeking removal of the impugned trademark 'SANOFF LABS' bearing registration no.4864995 from the Trade Marks Register.

A connected suit being CS(COMM) 1139/2024 filed by the petitioner against the respondent no.1 herein was decreed vide order dated 18th December, 2024.

One of the terms of the said decree was that the respondent no.1 herein (defendant in the suit) shall withdraw the aforesaid registration in his favour.

Issue notice.

Accordingly, the petition is allowed and the Trade Marks Registry is directed to take steps for removal of the entry in respect of registration no. 4864995 in the name of the respondent no.1.
