% 25.07.2019 In proceedings under Section 138 of the Negotiable Instruments Act, 1881, trial court vide impugned order has directed petitioner to pay fine of ₹7,00,000/-, out of which ₹6,90,000/- is to be paid as compensation to respondent-complainant and ₹10,000/- to be deposited as fine. In case of default of payment of fine and compensation, petitioner has been directed to undergo simple imprisonment for six months. Nominal roll of petitioner has been requisitioned and its perusal reveals that petitioner has already undergone sentence in default. Petitioner's counsel submits that this petition has become infructuous.
