By way of the present petition, the petitioner is challenging the order dated 07.12.2024 passed by the learned Additional Sessions Judge-04, Special Judge (NDPS), South-East District, Saket Courts, Delhi, whereby the learned Special Judge, while granting regular bail to the petitioner had imposed a condition, inter alia, that the applicant/accused shall not leave NCT of Delhi without prior permission of the concerned Court. 2.

This Court's attention has been drawn to the decision of Hon'ble Supreme Court in Akbal Ansari v. State (N.C.T. of Delhi): Criminal Appeal No. 4288 of 2024 wherein it has been held that such a condition cannot be imposed by a Court while granting regular bail. 3.

Considering the submissions made before this Court and in view of the decision of Hon'ble Supreme Court in Akbal Ansari v. State (N.C.T. of Delhi) (supra), the condition (i) in paragraph 7 of order dated 07.12.2024, to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the extent it places restriction on the petitioner from travelling outside NCT of Delhi, is set aside. The said condition shall now read as under: "i) The accused/applicant shall deposit his passport and shall not leave the country without prior permission of the concerned Court."
